Please note that although this is good news for all the people opposing software patents in europe: the proposed (unclear and too broad) directive is out the window, it also means the amendments that could have fixed the "loophole" for software patents are not in either.

AFAIK this means that 1. european countries are still free to patent software at their own discretion, and 2. you should expect new european proposals.

All in all though, I'm happy I'll still be able to do my work and not run idiotically high legal and financial risks for using my own intelligence and imagination.

My take on patents is the same take I have on the law in Australia (did you know there are 540 pages of legislation on the GST alone.. The Commissioner Discusses Australian Tax Issues):

When they want to get you they WILL get you

In a world where business has no ethics (and C# is a product of a company dedicated to eradicating great and open languages and standards) patents are necessary to protect inventors. And yet things that would make the world better for us all are bound within legislation that protects the very powerful corporations we try and protect ourselves from.

So my only view is.. keep under the radar and hope they don't find/target you

Does that mean that Microsoft won't be able to patent their most well known feature....."one false move could leave a system inoperable. ®" :-)

I'm not really a human, but I play one on earth. flash japh
