(OT) Linking, deep linkage, copyright, and web sites getting chilled

Indirectly, I came across this site Chilling Effects Clearinghouse. I was reminded of recent PM discussions here, concerning working to prevent site content hijacking, and more specifically this one by Ovid about his concerns of others mirroring his data without permission, commercial and non-commercial links to his content, as well as his copyright, er, rights.

I believe several monks here are owners of their web sites as well as its' PerlMonk-In-Charge and thought a quick reference to this additional resource concerning other viewpoints about the legal aspects of linking, deep linking, etc., might be useful.

From their web site: "Chilling Effects encourages respect for intellectual property law, while frowning on its misuse to 'chill' legitimate activity."  ...  "Conceived and developed at the Berkman Center for Internet & Society, Chilling Effects is a joint project of the Electronic Frontier Foundation (EFF) and clinics at Harvard Law School's Berkman Center, Stanford Law School's Center for Internet & Society, Boalt Hall's Samuelson Law, Technology and Public Policy Clinic, and other law schools across the country."

and

"Do you know your online rights? Have you received a letter asking you to remove information from a Web site or to stop engaging in an activity? Are you concerned about liability for information that someone else posted to your online forum? If so, this site is for you."

I was encouraged to see content like "Build Your Own DMCA Counter-Notice" as well as their efforts to collect copies of Cease and Desist letters into a searchable database.

These issues are serious ones for many of us here at PM, and it's worrisome that many commercial initiatives to "cover their assets" are altering, by sometimes imperceptible erosion, well established law in courtrooms that don't understand the issues.

I still have more reading to do at Chilling Effects before I have opinions about the site's content, so, if it's information is helpful or valuable to you, excellent!

    As an added bonus, the Chilling Effects site is all written in Perl. I hope you do find it helpful (or let us know why not).
